I just lost my job and I am planning to terminate the contract
with my maid. Is she eligible to Severance Payment upon termination
?
A domestic helper is eligible to Severance
Payment subject to the following conditions :
Has worked for the same
employer for not less than 24 months ;
Is dismissed by reason
of redundancy or is laid off. (In the case of domestic helper
contract, it is generally considered as Redundancy or Lay-off
when the employer does not immediately replace with another
helper after the termination).
How does this Severance Payment work out ?
Last month wages x 2/3
x no. of years of service
A domestic helper who
wishes to claim for Severance Payment should serve a written
notice to his employer within three months after the termination
takes effect. The employer shall make the severance payment
to the helper not later than two months from the receipt of
such a notice.
An employer who fails
to pay Severance Payment to his maid is liable to prosecution.
