My helper has served us for 5 years, Is she eligible to
Long Service Payment ?
A domestic helper is eligible to Long Service
Payment subject to the following conditions :
Has worked for the same
employer for not less than 5 years ;
Is terminated but :
not due to her serious misconduct
not for reason of redundancy
The helper dies ;
The helper resigns for
ill health and unfit to work as certified by a registered
medical practitioner.
If my helper refused to renew the contract after serving
us for 6 years, is she still eligible to Long Service Payment
?
If not less than 7 days
before the date of expiry of the employment contract, the
employer has offered in writing to renew the contract or re-engage
him under a new contract but the helper has unreasonably refused
the offer, the helper is not eligible for the Long Service
Payment.
Can a domestic helper be entitled both Long Service Payment
and Severance Payment at the same time ?
A domestic helper cannot
be simultaneously entitled to both long service payment and
severance payment.
How does this Long Service Payment work out ?
Last month wages x 2/3
x no. of years of service
Long service payment
should be paid to a domestic helper within seven days after
the date of termination of employment contract.
An employer who fails
to pay long service payment to a domestic helper is liable
to prosecution.
